Asbestos Manufacturers Withheld Evidence of Health Risk

Asbestos manufacturers as early as the 1930s concealed serious health concerns related to asbestos exposure. Information available in the 1930s suggested that asbestos was associated with serious respiratory problems.
In an effort to discredit adverse information, the asbestos industry funded various scientific studies intended to prove that asbestos was safe. The studies concluded just the opposite—asbestos was highly toxic and a carcinogen to humans.
Instead of alerting the public to the risk posed by asbestos, the manufacturers concealed the facts and continued producing asbestos-containing materials at an alarming rate.
Nearly every citizen in Canada will be exposed to asbestos at some point in their life. Asbestos was commonly used in the construction of residences, commercial buildings, and schools.
Fortunately, most people who are exposed to asbestos will not be exposed in high enough levels to become ill. Those people at the greatest risk for getting ill or developing an asbestos-related cancer are workers who are around asbestos on a regular basis.

Canadian Asbestos Exposure

Motley Rice attorneys not only represent asbestos victims throughout the United States but also serve as U.S. legal counsel for Canadian provincial workers’ compensation boards. These workers’ compensation boards help affected workers to provide return-to-work rehabilitation, compensation, health care benefits and a range of other services in the event of work-related injuries such as mesothelioma and asbestos exposure-related diseases.
The Canadian workers’ compensation boards have expended and will expend millions of dollars with respect to claims resulting from occupational exposure to asbestos-containing products. Under applicable law, the Canadian workers’ compensation boards have a subrogation interest against non-employer third parties who may be responsible for a workplace-related injury. Pursuant to this legal authority, Motley Rice attorneys have represented Canadian workers’ compensation boards since 1987 in seeking U.S. legal recoveries for the boards’ costs associated with asbestos-related claims.

    NEW YORK ASBESTOS LAWYER

Significant compensation for you and your family is the goal when you retain a New York asbestos lawyer at Weitz & Luxenberg.

Established in 1986, the New York asbestos-litigation law firm of Weitz & Luxenberg has grown into a national legal force with a staff of top-notch lawyers recognized coast to coast for obtaining multimillion-dollar verdicts and settlements for industrial workers diagnosed with occupational asbestos diseases, including such lethal illnesses as mesothelioma, asbestosis and asbestos-linked lung cancer.
October 25, 2010 – According to a leading New York asbestos lawyer with our firm, every year approximately 3,000 retirement-aged workers are caught off guard when doctors tell them the work they did decades ago has resulted today in the diagnosis of a lethal asbestos-related disease like malignant mesothelioma.
Mesothelioma is known the world over as the signature asbestos-related cancer. As an occupational disease, it is a preventable cancer, which makes it all the more tragic. Mesothelioma is caused by the negligence of employers and asbestos product manufacturers who knew of the toxic dangers of their products, but kept that information from employees to avoid the overhead expenses of providing a safe working environment.
    Industrial asbestos exposure
A New York asbestos lawyer with Weitz & Luxenberg disclosed that the workers who are most plagued by asbestos exposure are those who have spent years in the Navy, shipyard repair, the construction and automobile industries, and heating systems repair. Approximately 10,000 individuals die in this country every year from asbestos-related diseases.
Yet despite these mortal statistics, the United States is one of the few industrialized nations on Earth that has not banned the use of asbestos. While it is no longer mined in the United States, asbestos is still imported and used in construction and automobile products.
Congress passed laws in the 1980s limiting and controlling its use, but large quantities of asbestos-containing materials still remain in public buildings in New York and other U.S. cities that will eventually have to be removed.
    New York asbestos lawyer
Every asbestos lawyer working for New York-based Weitz & Luxenberg is proud of the firm’s reputation for providing effective mesothelioma legal support for workers diagnosed with job-related asbestos disease. We are the largest mass tort plaintiffs’ law firm in New York specializing in asbestos-injury litigation.
If you worked professionally with asbestos-based products any time in the past and have been diagnosed with an asbestos-related illness, you may be eligible for financial compensation under the law. For a free legal consultation with no obligations, please use the convenient communication form on this page and a representative from our firm will be in touch shortly.

An Introduction to Asbestos and Mesothelioma

Asbestos is a deadly mineral that has been used in thousands of products. When microscopic asbestos fibers are inhaled or ingested, they can cause a number of diseases, including mesothelioma and lung cancer. Of the diseases caused by asbestos, mesothelioma is the most aggressive, attacking the internal lining of the lungs and abdomen. Mesothelioma typically does not develop until decades after the asbestos exposure occurred.

Asbestos Exposure in California

The San Diego Naval Station has been a major site of asbestos exposure for individuals who later developed mesothelioma. Sadly, many of our clients are Navy men. In fact, more than 30 percent of Americans that develop mesothelioma were exposed to asbestos during military service.
Most military divisions utilized the cancerous substance for insulation purposes, but more than 300 products containing asbestos were used by the military, primarily by the Navy from the 1930s through the 1970s. Every ship and shipyard built by the Navy before the mid-70s was fitted with numerous asbestos-containing materials. Products such as turbines, generators, pumps, valves, gaskets, packing, cements and pipe covering all contained asbestos.
The San Diego naval base had active ship repair basins until 1945. After 1945 and up to 1972, members of the Navy used the basins to dispose “solid waste, scrap metal, demolition debris, lubricants and oils, and paint sludge.” Shipyards have long been associated with asbestos-related diseases, and evidence reported by U.S. shipyard workers employed during and after World War II appears in a 1983 hearing before a House of Representatives subcommittee of the Committee on Government Operations.2 Furthermore, after the SS Morro Castle burned down in 1934, government regulations mandated greater fire safety and use of fire-retardant materials like asbestos.

The majority of individuals who have been exposed to asbestos encounter the so-called “magic mineral” in their line of work, often due to inadequate safety precautions. Others are exposed to asbestos indirectly when they come in contact with the clothing of a family member involved in a high-risk asbestos occupation.
Asbestos has been widely used in many industrial products including cement, brake linings, roof shingles, flooring products, textiles, and insulation. When microscopic asbestos dust particles becomes airborne, they can be inhaled or swallowed and can cause serious health issues.
Common work environments where a mesothelioma or cancer patient may have encountered asbestos include shipyards, oil refineries, sheet metal plants, automotive plants, construction sites, and many more. Here is a complete list of occupations that have been linked to asbestos exposure.

Giving Back to Mesothelioma Patients & Families

In 2010, the Simmons Law Firm established the Simmons Mesothelioma Foundation, a private, non-profit organization dedicated to supporting research and advancing awareness about this rare cancer. The Foundation partners with established experts and thought-leaders in the mesothelioma research field. Learn more about the Foundation’s current mesothelioma research partners.
As a long-time supporter of the Mesothelioma Applied Research Foundation and the Asbestos Disease Awareness Organization, the Simmons Law Firm has an extensive history of supporting the fight against mesothelioma and cancer. The firm has also pledged over $10 million to establish the Simmons Cancer Institute at the Southern Illinois University School of Medicine. The institute provides extraordinary new resources to enhance treatments and implement the continuing search for a permanent cure. It is the largest single gift in the history of SIU and establishes the university as home to one of the leading cancer facilities in the United States.

Asbestos Exposure in California Today

Asbestos has not yet been banned in the United States. Its use is regulated, but it is still used in products today. Asbestos has been classified by the International Agency for Research on Cancer as a human carcinogen. This assessment is supported by the International Labor Organization (ILO) and the World Health Organization (WHO), both of which believe that the future use of asbestos should be banned.
